Your air passenger rights

As an air passenger, you have rights that protect you depending on the situations you encounter. These include : 

  • the right to information ;
  • the right to reimbursement or re-routing in the event of flight cancellation or denied boarding; the right to reimbursement when the delay is at least five hours ;
  • the right to assistance and, in certain circumstances, the right to compensation in the event of long delay, cancellation or denied boarding ;
  • the right to complain and to have access to means of seeking redress ;
  • the right to travel under the same conditions as other citizens if you have a disability or reduced mobility.

 

European legislation also stipulates who is responsible in the event of long delays, in the event of death or injury, or if your baggage is mishandled, to ensure that you always get what you are entitled to.

Conditions

  • Cancellation

    In the event of flight cancellation, passengers can choose between : 

    • Re-routing via another flight 
    • The airline will take care of the passenger during the waiting period (catering, accommodation, transfers between the accommodation and the airport). 
    • Ticket refund  
    • If a flight departs via a connection, the return flight to the original point of departure may be covered. 

    In the event of cancellation, the passenger has the right to compensation, except

    • If the passenger is notified two weeks before departure or, if less notice is given, if another flight is offered at a time close to the original schedule.  
    •  If the cancellation is due to exceptional circumstances.  
  • Delay

    Passengers can obtain assistance (catering, accommodation, transfers between their accommodation and the airport) if their flight is delayed by: 

    • Two hours or more for flights of up to 1,500 km, 
    • Three hours or more for intra-Community flights over 1 500 km 
    • For other flights: Three hours or more for flights over 1,500 km up to 3,500 km, four hours or more for flights over 3 500 km. 

    Passengers are entitled to have their ticket refunded if the departure delay is at least 5 hours. They may also request a return flight to their original point of departure if the connecting flight is delayed. 

    Passengers may be entitled to compensation if they reach their final destination three hours or more after the initially scheduled arrival time. 

  • Denied boarding
    1. In the event of overbooking, passengers may be denied boarding. 
    2. The airline must call on any volunteer passengers who are willing to give up boarding. 
    3. Passengers who are denied boarding may: 
    4. Choose another flight or have their ticket refunded, 
    5. Benefit from assistance from the airline during the waiting period (catering, accommodation, transfers between the accommodation and the airport), 
    6. Receive compensation 
    7. Voluntary passengers may: 
    8. Choose another flight 
    9. Have their ticket refunded if they decide not to take another flight.

Compensation

In the event of delay or cancellation at departure, or denied boarding, the lump-sum compensation varies between 125 and 600 euros depending on the distance of the flight and the delays.
